How Court Approval Works

And why it’s a protection, not a hurdle.

Every state requires a judge to approve the sale of structured settlement payments before any funds change hands. The Structured Settlement Protection Act, in some form in all 50 states, sets that rule. It is reinforced federally by IRC § 5891, which imposes a 40% excise tax on any factoring transaction that skips court approval. No legitimate buyer closes a sale without an order from the bench.

The judge’s job is to find that the transfer is in your best interest and the best interest of any dependents. That determination weighs the use of funds, your financial picture, the alternatives available to you, the discount rate, and the specific terms of the agreement. The hearing itself is short, and in many states is available by phone or video.
